Malegaon bomb blasts: Time for a fresh probe


Malegaon - a predominantly a Muslim populated town - which had once carved out a niche for itself because of its powerloom industry, is today seething with anger. A town and its people which had decisively defeated the gameplan of the fanatics - who had planned that bomb blasts on the day of the Shab-e-Barat would definitely provoke a communal conflagaration - are today finding that they have been cheated by the ruling elite.
If the aftermath of the bomb blasts on Shab-e-Barat the town had witnessed many communal harmony rallies, today one notices perceptible change in the ambience. If earlier the anger of the Muslim community was directed against the unknown terrorists who had conspired to kill innocents, today the communalised police machinery has also become an important target of the people's ire.

And it was not surprising that an unusual type of sit-in on the streets of Malegaon on the 10 th Novemeber largely went unnoticed. As reported by this paper, " Protesters donned same kind of hoods which police places on the heads of arrested criminals. Protesters also wore black bands around their arms in a show of protest against official attempts to portray the victims as terrorists."

The unique sit-in was part of the ongoing protest campaign by the townspeople. In fact, the city observed a complete bandh on the 14 th November as part of its protest against the attitude of the police and authorities. It was a day when Chief Minister of Maharashtra, Vilasrao Deshmukh, came to visit the town to lay the foundation stone of a hospital. And the key demands of this bandh were the "investigations into the blasts be handed over the the Central Bureau of Investigations (CBI)" , Maharashtra Control of Organised Crime Act (MCOCA) should be removed from the cases filed against the arrested youths, report of the Patel Commission must be released and its recommendations put into action, and a financial package must be announced to develop Malegaon and its powerloom industry. It need not be repeated that all the demands raised by the minority community, with due help from human rights organisations, have fallen on deaf ears. As of now, it is for everyone to see that tragedy of Malegaon continues unabated.

Gone are the days when the needle of suspicion was pointed towards extremist Hindutva organisations like Bajrang Dal by the Prime Minister himself. Gone are the days when enough RDX was recovered from many Hindutva sympathisers from the adjoining, areas and the police just decided to gloss over such clues.

The state's law and order machinery has hurriedly reached a conclusion that members of SIMI, a banned organisation of Muslim students, carried out the blasts with the intention to create religious animosity between Hindus and Muslims.

Interestingly, the media has duly noted the unusual hurry shown by the Maharashtra police. It feels that the it is ‘aimed at stalling the transfer of the September 8 Malegaon blasts to the CBI. According to the Indian Express Mumbai, November 27: In a move believed to be aimed at stalling the transfer of the September 8 Malegaon blasts case to the CBI, the Anti Terrorist Squad (ATS) today claimed it had cracked the case. Interestingly, on October 30, it had made the same claim and at today’s press conference, presided over by DGP, Dr P S Pasricha, it had little more to offer by way of detail.

"We have successfully detected the Malegaon serial blasts case, and have arrested eight men, all of them former SIMI members. We are on the lookout for eight others," said Pasricha. He, however, refused to confirm whether Pakistan, its intelligence agency Inter-Services Intelligence (ISI), the Lashkar-e-Toiba or any other terrorist outfit was behind the blasts. The Maharashtra police is well aware that if an outside agency, which could be construed as impartial, takes up the case, then the one-sided role of the Maharashtra police can come under scanner, and it will have to do lot of explaining. From day one, there have been allegations that the police has not remained even-handed while dealing with the case. Apart from providing lax security at the time of the Shab-e-Barat celebrations, it is also alleged that it did not follow some vital clues. Human rights activists, who had the opportunity to interact with the local senior police officials, have also discovered how biased they have been towards the minority community.

A fact-finding team consisting of Justice (retired) Hosbet Suresh, Prof. Shekhar Sonalkar, Jatin Desai, Suresh Khairnar and Nandini Chavan visited Malegaon on October 1-2, 2006 and met cross section of the people including top police officials. Its enquiry report, "Concerned Citizen’s Inquiry Report of Malegaon Bomb-blasts" concludes with the obserevation. "The police appears quite sluggish in its investigation as compared to its action role after Bombay bomb blast. After our discussion with police officer Shri Rajvardhan, it appears that the police is convinced that Bomb blast was carried out by Muslims (with the involvement of SIMI).

The police is not taking seriously the allegations by the Muslim leaders of Malegaon that some Hindu organizations could have been involved. Mr. Rajvardhan, said that more than 300 Hindus were interrogated but it is being done rather secretively, if it’s at all being done. He fears that if he actively pursues Hindu organizations in this respect, there will be backlash by Hindus and Communal Harmony, which the police is trying hard to maintain, will be disturbed and, again, Muslims will suffer. We did not have hard evidence to interrogate Militant Hindu organizations. But when it comes to Muslims, it seems police has no such fear and they are detaining some Muslims for interrogation, especially those who have SIMI past. But those detained so far are poor Muslim powerloom workers. Muslim leaders want to know why police is not arresting the main brain behind it, why is it arresting poor unknown power loom workers. The police, on the other hand, says that how can we reach the main brain without interrogating those through whom this work was done.

In one of his perceptive write-ups "Malegaon blasts —partisan approach and biased police" leading secular activist Asghar Ali Engineer tells us :"..[I]n case of Malegaon it appeared, as the police is hardly interested in catching the culprits. Most of the human rights activists and Muslim leaders from Malegaon felt that the bombs could have been planted by some extremist Hindu organisations like the Bajrang Dal."

The Malegaon Muslim leaders maintain that in Nanded in the month of April 2006, before Malegaon blasts, there was explosion in the house of an RSS activist, Laxman Rajkondwar, in which two persons were killed, one of whom was Laxman Rajkondwar’s son, Naresh
Rajkondwar. Also, in Ahmednagar, some bomb shells and 195 Kgs. RDX was caught from one Shankar Shelke’s shop on 16th September. The shop owner committed suicide the next day. Then, more than 300 Kgs of ammonium nitrate, timers and fusers were caught from the house of a Sarpanch of a village few kilometres from Aurangabad.

Many activists and Muslim leaders urged upon the government and police authorities in Maharashtra to investigate the connection between Malegaon explosions and these incidents, but the police and the ATS authorities turned a deaf ear. The ATS and district police had prejudged the whole issue, and was connecting these blasts to Mumbai train blasts and were looking for ISI connection.

There was no headway until recently, when the police started arresting some labourers from Malegaon and then they arrested two Unani doctors, alleging they have Pakistani connection. There is no doubt police is highly biased in investigating Malegaon bomb blasts, as if it has an inbuilt bias against Muslims in investigation."

Engineer further adds: "Malegaon Muslim leaders also say that though so much RDX, ammonium nitrate and fusers, timers etc. were caught from some Hindu shops and houses, police is not prepared to look into this aspect and interrogate these persons in connection with Malegaon blasts. I met the S.P. Rural of Nashik district who is in charge of bomb blast investigation in Malegaon and had detailed discussion with him. It was quite clear that he also had same approach that it is work of some Muslims and there is no possibility of any Hindu being involved.

His logic was that Malegaon city is a Muslim majority area and no Hindu will dare do it in Muslim majority area. It was strange logic indeed. It is just Malegaon that is Muslim majority area, not even district. Along with rural areas, it is Hindus who are in majority and then what about the district, state and country? He also argued that if a Hindu had done it he would have tried to inflict maximum loss of life and would have planted bomb at night when many more people gather.

But the time bombs went off on 8th September (1-30 P.M.) was also a peak time as thousands of Muslims go for prayer on Friday, especially on Shab-e-Barat and, if loud speakers had not stopped for few minutes, thousands of Muslims would have come out of the mosque and damage would have been much greater. There was no explanation for this. The Muslim leaders also told us that bombs were kept on two cycles, which were bought from a shop in Malegaon and buyers’ sketches were prepared by the police.

However, Muslim leaders say, police has made no efforts so far to arrest those two persons whose sketches were prepared, and instead arrested Nurul Huda and others. What happened to those two persons who bought cycles? Who were they? Can the police jump to the final conclusion as to who the culprits are without first tracing those whose sketches were prepared? Police has no answer.

The Malegaon Muslims are very perturbed that why police is not interrogating extremist Hindus and why is it after some Muslims from Malegaon? Has the police completely written off the possibility of some extremist Hindus being involved? Rajwardhan, S.P. Police, told us that he has interrogated some Hindus but he is not prepared to disclose their names? Why? When the police interrogates Muslims their names are publicised through the media. Nurul Huda was detained and his name was publicised in the media. But so far no Hindu who was interrogated or detained has come out in the media. Why keep these names under wrap?

We feel that no Muslim, much less from Malegaon itself, would keep bombs in a mosque, that too on Friday and a holy festival. When I asked Shri Rajwardhan why should a Muslim keep bombs to kill Muslims on such a day of festivity, his reply was that they intended to cause Hindu-Muslim riot. Again, if Hindu-Muslim riot takes place, it is Muslims who will heavily suffer as the past riots in Malegaon clearly show. Why then Muslims from Malegaon itself should do something to cause Hindu-Muslim riots? Perhaps he was suggesting that ISI of Pakistan was interested in inciting Hindu-Muslim riots."In her writeup, Jyoti Punwani, political commentator similarly raises questions about the one-sided approach of the police. (The Times of India, 22 November 2006, "Victims of Terror").

"..After the Malegaon arrests, astute Muslims are wondering whether the Indian government is trying the US tactic of pitting Muslim sects against one another. The Ahle-Hadees obey the Qur’an strictly; their women wear the much-maligned naqab.

Tearing it off, throwing it on the faces of male relatives who are the accused, trampling it under foot, and threatening that this would happen to all the women in the family, what could be the consequences of such action by the police on the victims and the community?

A substantial number of SIMI and Ahle-Hadees followers are educated. At least five of those arrested, and many of those "picked up" (for questioning, often for days, with no record of their detention), are professionals.

First-timers at police stations, they initially felt incredulous and indignant, and finally helpless and bitter at the way they, their parents and their religion have been humiliated, for no "crime" other than being related to a SIMI member, or being active members of a mainstream Muslim sect.

Have such tactics been used to investigate another blast in April, where two Bajrang Dal boys died while making bombs inside an RSS activist’s house in Nanded? How widespread were the links of that conspiracy, given that fake beards and moustaches were found at the site? The ATS has been uncharacteristically discreet here.

If having once been a member of SIMI makes you a terror suspect, what does that make members of the Bajrang Dal, which openly instigates violence against minority Indians? What is certainly suspect is the July 11 investigation."

Looking back, we are not yet clear about the whereabouts of the two people who purchased the two cycles in Malegaon which were used in the bomb blast. In the initial stages of the investigation, police had released sketches of the two persons who were from some Hindi speaking area. Even a layperson may tell that they would be able to shed more light on the conspiracy which went into making it.

The conspiracy of silence maintained by the police over the recovery of bomb shells and 195 kg RDX from some Shankar Shelke's shop on 16 th September, and the strange facts around this affair, are baffling. This man, who’s godown had stocked this was found dead the next day and an employee of his was absconding. Similarly the recovery of more than 300 Kgs of ammonium nitrate, timers and fusers from the house of a Sarpanch of a village few Kilometres from Aurangabad has also also gone unnoticed.

Any justice loving person would agree that there is an urgent need that the whole investigation is handed over to some central agency like CBI, so that we are able to reach the kernel of truth. Prime Minister Manmohan Singh has, of late, been talking about the need to rectify the injustice which the polity has done towards the minority community. It is time that he shows his sincerity by asking the CBI to take up the probe.

Summarised Sachar Report on Status of Indian Muslims

While issuing notification during March 2005 the Prime Minister’s Office had noted that there is lack of authentic information about the social, economic and educational status of the Muslim community of India. The PMO had observed that such lack of information comes in the way of planning, formulating and implementing specific interventions, policies and programmes to address the issues relating to the socio-economic backwardness of this community.
Hence, the Prime Minister’s High Level Committee was mandated to obtain relevant information from departments / agencies of the Central and State Governments and also conduct an intensive literature survey to identify published data, articles and research on relevant status of Muslims in India. The Committee was to find out the asset base and income levels of Muslims relative to other groups across various states and regions. It had to find out the level of socio-economic development of Muslims in terms of relevant indicators such as religious rate, drop out rate, MMR, IMR etc.
What is their relative share in public and private sector employment?
Is this share in proportion to their population in various states?
If not, what are the hurdles?
The Committee was to find the proportion of OBCs from the Muslim community in the total OBC population.
Are the Muslim OBCs listed in the comprehensive list of OBCs, prepared by the National and State Backward Classes Commissions.
What is the share of Muslim OBCs in the total public sector employment for OBCs.
The Committtee had also to find out whether the Muslim community has adequate access to the education and health services, municipal infrastructure, bank credit and other services provided by the Government and public sector entities.
This was to be compared with the access enjoyed by the other communities.
What is the level of social infrastructure (schools, health centres, ICDS centres etc.) located in areas of Muslim concentration in comparison to the general level of such infrastructure.
The Committee was to identify areas of intervention by the Government to address the relevant issues relating to the social, economic and educational status of the Muslim community.
2. The Report which was presented to the Prime Minister on 17 November 2006 and was tabled in Parliament on 30 November 2006 has twelve chapters. Chapter I is introductory. Chapter II talks of Public Perceptions and Perspectives gathered by the Committee during its widespread interaction with the people and their representatives while it visited 13 most Muslim populous states and organized 5 Round Table Conferences in Delhi. Chapter III deals with the population size, distribution and health conditions of Muslims etc. In the subsequent chapters the Committee has analyzed the educational condition of Muslims, their economy and employment, their access to bank credits, their access to social and physical infrastructure, their poverty level and standard of living, their participation in government employment and programmes and empirical situation of Muslim OBCs. There is a separate chapter of Wakfs talking about economic potential of Wakf assets, constraints regarding the fulfillment of Wakf objectives and suggestions for overcoming such constraints. In the last chapter the Committee has given its recommendations.
3. The Committee noted that the public opinion in India was divided on reservation. Some argued that policies that promote equality must aim at a substantive equal outcome, not merely formal equal or identical treatment. Reservations or a separate quota for Muslims in employment and educational institutions was viewed as a means to achieve this. Others felt that reservations could become a thorny issue and have negative repercussions. Still others argued that good educational facilities combined with non-discriminatory practices are adequate for Muslims to compete. Those who argued for reservation policies often differed on who should be their beneficiary. Some argued that this facility should only be available to ‘dalit’ Muslims, while others suggested that the entire Community should benefit from it. For some an economic criterion was an ideal basis for reservations. They felt that this would fail to address the problem arising out of social discrimination. There were voices that questioned the non-availability of the Schedule Caste quota for Muslims while it was available to the followers of three religions.
4. A large cross section of the people was of the conviction that political participation and representation in governance structures are essential to achieve equity. Many alleged that participation is denied to Muslims through a variety of mechanisms. While it was pointed out that many names of Muslims were missing in the voter lists of a number of states, the Committee’s attention was also drawn to the issue of Muslim concentration constituencies of Assemblies and Parliament declared as reserved for Schedule Caste persons while constituencies with very low Muslim population but high SC concentration remain unreserved. Hence, it was argued that Muslims are being systematically denied political participation. The Committee collected data from all over the country in the light of which the second allegation regarding reservation of constituencies was found to be correct. For the first allegation the Committee did not collect any data.
5. In the field of literacy the Committee found that the rate among Muslims was far below the national average. The gap between Muslims and the general average is greater in urban areas and women. 25 per cent of Muslim children in the 6-14 year age group have either never attended school or have dropped out. Expansion of educational opportunities since Independence has not led to a convergence of attainment levels between Muslims and all others. Drop out rates among Muslims are higher at the level of primary, middle and higher secondary. The Committee observed that since artisanship is a dominant activity among Muslims technical training should be provided to even those who may not have completed schooling. The disparity in graduation attainment rates is widening since 1970s between Muslims and all other categories in both urban and rural areas. In premier colleges only one out of 25 under-graduate students and one out of 50 post-graduate students is a Muslim. Unemployment rate among Muslim graduates is the highest among all socio-religious communities. Only 3% of Muslim children among the school going age go to Madarsas. There is dearth of facilities for teaching Urdu. Lower enrolment in Urdu medium schools is due to limited availability of such schools at the elementary level.
6. The Committee found that Muslim parents are not averse to mainstream education or to send their children to affordable Government schools. But the access to government schools for Muslim children is limited. There is non-availability of schools within easy reach for girls at lower levels. Absence of girls hostels and female teachers are also impeding factors. The changes in the educational patterns across the various religious groups and communities suggests that the schedule castes and schedule tribes have definitely reaped the advantages of targeted government and private action supporting their educational progress. This reflects the importance of affirmative action. The sharper focus on school education combined with more opportunities in higher education for Muslims seems desirable. Moreover, skill development initiatives for those who have not completed school education may also be particularly relevant for some sections of Muslims given their occupational structure.
7. Bidi workers, tailors and mechanics need to be provided with social safety nets and social security. The participation of Muslims in the professional and managerial cadre is low. Muslim regular workers are the most vulnerable with no written contract and social security benefits. Muslim regular workers get lower daily earnings in both public and private jobs compared to other socio-religious communities. Since a large number of Muslim workers are engaged in self-employment, skill development and credit related initiatives need to be tailored for such groups.
8. The average amount of bank loan disbursed to the Muslims is 2/3 of the amount disbursed to other minorities. In some cases it is half. The Reserve Bank of India’s efforts to extend banking and credit facilities under the Prime Minister’s 15-point programme of 1983 has mainly benefited other minorities marginalizing Muslims. Muslim community is not averse to banking and more improvements can be brought about with specific measures. Inadequate targeting and geographical planning has resulted in a failure to address the economic problems of Muslims in rural areas. Some banks have identified a number of Muslim concentration areas as negative geographical zones where bank credit and other facilities are not easily provided. Steps should be introduced to specifically direct credit to Muslims, create awareness of various credit schemes and bring transparency in reporting of information.
9. There is a clear and significant inverse association between the proportion of the Muslim population and the availability of educational infrastructure in small villages. Muslim concentration villages are not well served with pucca approach roads and local bus stops. The concentration of Muslims in states lacking infrastructural facilities implies that a large proportion of the community is without access to basic services. In both urban and rural areas, the proportion of Muslim households living in pucca houses is lower than the total population. Compared to the Muslim majority areas, the areas inhabiting fewer Muslims had better roads, sewage and drainage and water supply facilities.
10. Substantially larger proportion of the Muslim households in urban areas are in the less than Rs.500 expenditure bracket.
11. The presence of Muslims has been found to be only 3% in the IAS, 1.8% in the IFS and 4% in the IPS. The share of Muslims in employment in various departments is abysmally low at all levels. Muslim community has a representation of only 4.5% in Indian Railways while 98.7% of them are positioned at lower levels. Representation of Muslims is very low in the Universities and in Banks. In no state does the representation of Muslims in the government departments match their population share. Their share in police constables is only 6%, in health 4.4%, in transport 6.5%. There is need to ensure a significant presence of Muslims especially in those departments that have mass contact on a day to day basis or are involved in sensitive tasks. Targeted programmes are required to be put in place. The coverage of Muslims in ICDS programme is poor in most states.
For the Maulana Azad Education Foundation to be effective the corpus fund needs to be increased to 1000 crores. Total allocation in the four years 2002 to 2006 for Madarsa Modernization Scheme is 106 crores. The information regarding the Scheme has not adequately percolated down. Even if the share of Muslims in elected bodies is low they and other under represented segments can be involved in the decision making process through innovative mechanisms.
12. The Presidential Order of 1950 is inconsistent with Article 14, 15, 16 and 25 of the Constitution that guarantee equality of opportunity, freedom of conscience and protect the citizens from discrimination by the State on grounds of religion, caste or creed. Most of the variables indicate that Muslim-OBCs are significantly deprived in comparison to Hindu-OBCs. The work participation rate (WPR) shows the presence of a sharp difference between Hindu-OBCs (67%) and the Muslims. The share of Muslim-OBCs in government/ PSU jobs is much lower than Hindu-OBCs. Out of every hundred workers about eleven are Hindu-OBCs, only three are Muslim-Gen and one is a Muslim-OBC. The monthly Per Capita Expenditure of Muslims is much lower than the national average. Benefits of entitlements meant for the backward classes are yet to reach Muslim OBCs. The condition of Muslims in general is also lower than the Hindu-OBCs who have the benefit of reservations.
13. There are about 5 lakh registered Wakfs with 6 lakh acre land and Rs 6,000 crore book value. But the gross income from all these properties is only 163 crores i.e. 2.7%. The management of Wakf Boards is unsatisfactorily due to inadequate empowerment of the State Wakf Boards and Centreal Wakf Council. Encroachment of Wakf properties by the State is a common practice. The attitude of the State Governments and their agencies has resulted in large scale abrogation of the cherished objectives of the Wakfs. Fresh institutional support is essential. A number of Wakf properties have been acquired although compensation was not paid. High legislative, administrative and judicial priority should be accorded to Wakf matters in order to improve the management of about five lakh properties across India. The Chairman and Members of the State Wakf Boards can be selected from a list of eminent persons in each state. The Government should create a new cadre of officers with knowledge of Islamic law to deal with the specific affairs of the Wakfs efficiently. A National Wakf Development Corporation and State Corporations should be established. The lease period of Wakf properties may be increased up to 30 years where the property is used for education, health care and other purposes consistent with the objects of the Wakf provided the lessee is a registered society or a registered trust doing charity work. Wakf properties should be exempted from Rent Control Act and Land Acquisition Act. Wakf Tribunal should be manned by full time presiding officers appointed exclusively for Wakf purposes. The Public Premises Eviction Act should be applied to remove encroachments from Wakf properties. Failure on the part of the state and statutory bodies entrusted with safeguarding Wakf properties has caused disquiet in the Muslim community.Recommendations
14. The Muslim community exhibits deficits and deprivation in practically all dimensions of development. Mechanisms to ensure equity and equality of opportunity to bring about inclusion should be such that diversity is achieved and at the same time the perception of discrimination is eliminated. Creation of a National Data Bank (NDB) where all relevant data for various Socio Religious Communities are maintained has been recommended along with an autonomous Assessment and Monitoring Authority to evaluate the extent of development benefits which accrue to different Socio Religious Communities through various programmes. An Equal Opportunity Commission should be constituted to look into the grievances of the deprived groups. A carefully conceived nomination procedure should be worked out to increase inclusiveness in governance. The Committee has recommended elimination of the anomalies with respect to reserved constituencies under the delimitation scheme.
The idea of providing certain incentives to a diversity index should be explored. Incentives can be related to this index so as to ensure equal opportunities to all socio religious communities in the fields of education, governance, private employment and housing. State functionaries should be sensitive to the need to have diversity and the problems associated with social exclusion. A process of evaluating the content of the school textbooks needs to be initiated and institutionalized. The UGC should evolve a system where part of the allocation to colleges and universities is linked to the diversity in the student population. To facilitate admissions to the most backward amongst all the socio religious communities in the regular universities and autonomous colleges, alternate admission criteria need to be evolved. Providing hostel facilities at reasonable costs for students from minorities must be taken up on a priority basis. Teacher training should be compulsory ensuring in its curriculum the components which introduce the importance of diversity and plurality. The teachers should be sensitized towards the needs and aspirations of Muslims and other marginalized communities. The states should run Urdu medium schools. Work out mechanisms whereby Madarsas can be linked with a higher secondary school board so that students wanting to shift to a regular mainstream education can do so after having passed from a Madarsa. Recognition of the Madarsa degrees for eligibility in competitive examinations is desirable. The Committee recommended promoting and enhancing access to Muslims in Priority Sector Bank Advances. The real need is of policy initiatives that improve the participation and share of the Minorities, particularly Muslims in the business of regular commercial banks. The community should be represented on interview panels and Boards. The underprivileged should be helped to utilize new opportunities in its high growth phase through skill development and education. Provide financial and other support to initiatives built around occupations where Muslims are concentrated and have growth potential.

Verily Tawheed is the first obligation that all the Messengers called to which formed the foundation of their call and their invitation to the people. Allah (swt) says: ‘We sent to every Ummah a messenger to command the people to submit to Allah exclusively and to reject Taghoot’. [EMQ 16:36]. Tawheed is the greatest Haq of Almighty Allah (swt) over his servant. It has been reported in Bukhari and Muslim, in a hadith narrated by Muadth Ibn Jabal (ra), that the Messenger Muhammad (saw) said: ‘The right of Allah over his servant is to submit to him exclusively and not to associate anything with him’. Whoever establishes the Tawheed enters Jannah and whoever negates the Tawheed they are from the people of hellfire. Establishing Tawheed is the path to happiness in this life and in the hereafter, whereas violating the Tawheed is the path of the miserable that will be doomed in this life and in the hereafter. Verily Tawheed is the only way for the unity of the Muslim Ummah and the Muslim world, for failure to establish the Tawheed amongst Muslims will be the cause of their failure, divisions and sectarian disputes.


Arqan al Tawheed

We must be aware that the Tawheed is composed of two pillars, Al Kufr bil Taghoot to reject all Taghoot and Al-Imaan billah to believe in Allah (swt). And know that man will never become a believer in Allah unless he rejects and disbelieves in the Taghoot. Whoever does not reject the Taghoot, then he has contradicted the basic message of all prophets and has contradicted the worship of Allah at its very roots for Allah (swt) says: ‘We sent to every Ummah a messenger to command the people to submit to Allah exclusively and to reject Taghoot’. [EMQ 16:36]


One cannot have Imaan in Allah (swt) unless he firsts disbelieves in the Taghoot. This is since Imaan and Shirk (polytheism) cannot be gathered together in one heart, for they are opposites. So one must remove all worship offered to other than Allah first and then establish worship to Allah (swt) alone afterward. Therefore, to believe in Allah (swt) we must reject that which contradicts the belief in Allah (swt) and we must therefore reject the Taghoot for Allah (swt) says “Whoever rejects Taghoot and believes in Allah then he has grasped the most trustworthy handhold.” [al Baqarah 2:256] Mujaahid [d.103 h.] said ‘The most trustworthy handhold is imaan’ and as-Suddi [d.127 h.] said it is ‘Islam’ [Tafseer Ibn Kathir]. This ayah makes clear that there can be no Imaan without rejection of TTaghoot, and that believing in Allah (swt) as the only object of worship, as the only ‘illah’ is dependent upon rejecting any other object of worship.


The Kalimah of Tawheed, ‘Laa ilaaha ill Allah’ is a statement of negation nafi and affirmation ithbaat. When we are saying ‘Laa ilaaha’ we are rejecting all worship for other than Allah (swt) and when we say ‘ill Allah’ we are affirming that the worship is only for Allah (swt). Worship includes obedience Taa’ah. This means that we must accept that only Allah can legislate for us for Allah (swt) says "…The rule hukm is for none but Allah. He has commanded that you worship none but Him, that is the Straight Deen but most men know not." [al Yusuf 12:40] and "…and He makes none to sharein His Rule…" [al Kahf 18:26]



Dear Brothers and Sisters, the way in which we are obliged to establish the above conditions and pillars of Tawheed, we are also obliged to fear and distance ourselves from shirk and to take precaution from all of its types, its gates and exits, whether the big shirk or small one, as verily, the biggest oppression is shirk and Allah (swt) will forgive everything except shirk. Whosoever falls into shirk, Jannah is forbidden for him and his residence will be hellfire: ‘Allah does not forgive Shirk or to associate with Him anything, but forgives less than that to whomever He wills’ [an Nisaa’ 4:48] Therefore Muslims should be aware about what negates and contradicts Tawheed in order to make a shield for themselves, protecting them from apostasy.


at-Taghout

As for the Shari’ah definition of Taghoot, it is that which is worshiped, obeyed, submitted to, or followed other then Allah (swt). This may include Shaytan idols, stones, sun, stars, angels, or even human beings. Likewise saints, graves, pirs, rulers and leaders, other ruling systems besides Islam may also be falsely worshipped and made into Taghoot. Imaam Maalik (d.179ah) said ‘The Taghoot is anything that is worshipped apart from Allah’ [Tafseer Ibn Kathir]. Imaam Ibn al Qayyim (d.751ah) said, ‘The Taghoot is anyone to whom the slave [a’bd] goes beyond the limits whether it is someone worshipped [ma’boodin] or followed [matbooi’n] or obeyed [mutaai’n’].


Shaykh Muhammad ibn A’bdul Wahhaab [d.1206 h.] said ‘The Taaghout are many and their heads are five: Iblees, whoever is worshipped and is pleased with that, whoever calls the people to worship himself, whoever claims to possess anything from the knowledge of the unseen and whoever rules by other than what Allah has sent down’ as well as ‘The word Taghoot is general. So everything that is worshipped besides Allah, while being pleased with this worship – whether it is something worshipped, someone followed, or someone obeyed in the absence of obedience to Allah and His Messenger, then that is considered Taghoot.


With regards to the Rulers of the Muslim Lands today who many claim for them to be believers, not only do they willingly obey, follow, submit and bow down to the laws of the kuffar, resulting in the abolishment in the first Pillar of Tawheed i.e. Al Kufr bil Taghoot, they themselves order the people to be obey, follow and submit to them and the kuffr which the legislate, and therefore become Taghoot themselves. Indeed the list of their kuffr, shirk and the rejection and hatred for the shariah of Allah (swt) is overwhelming. So whoever rules by other than what Allah revealed, implementing it knowingly, then he is a Taghoot, even if he claims what he may claim. And indeed Allah has declared him a disbeliever.


So the fact that the Taghoot does not only include stars, stone and wooden idols but also people who make laws against the shari’ah is manifest from the Quran and supported from the statements of the salaf and the classical scholars. The following ayah proves that whoever rejects Quran and Sunnah and prefers man-made law either voting for that, supporting it or going to judgement in courts based on that has removed himself from Islam. Allah (swt) says “Have you seen those who claim that they believe in that which was sent down to you and before you and they wish to go for judgement to the Taghoot while they have been commanded to reject them? But Shaytaan wishes to lead them far astray. And when it is said to them ‘Come to what Allah has sent down and to the messenger’ you see the munaafiqeen turn away from you with aversion. How then when a catastrophe befalls them because of what their hands have sent forth they come to you swearing by Allah, ‘We meant nothing more than goodwill and conciliation’.” [an Nisaa’ 4:60-62]


This verse was revealed in relation to a Muslim who was debating with a Jew about a certain issue. Rather then making Tahakum to Allah (by referring to Muhammad (saw)), he referred to a Taghoot Sorcerer (Al Ka'ab ibn Ashraf) for judgment and for this he became a Kafir and apostatized from the deen of Islam. Ibn Katheer [d.774 h.] said ‘The ayah has a general meaning as it chastises all those who refrain from referring to the Quran and Sunnah for judgement and prefer the judgement of whatever they chose of falsehood, which befits the description of Taghoot here. This is why Allah said “….and they wish to go for judgement to the Taghoot…” [Tafseer Ibn Kathir].

Thus, the ayah is clear in declaring the kufr disbelief of those who went to other than the revelation from Allah for laws and judgement. The ayah said “…claim that they believe…” which means that they don’t believe. Allah (swt) made clear that accepting judgement and legislation from other than Allah and His messenger is kuffr [disbelief], Allah (swt) says “But no by your Lord, they can have no imaan (belief) until they make you judge in all disputes among them and find in themselves no resistance against your decisions and accept them with fullest submission.” [an Nisaa’ 4:65]


The Way to Reject Taghoot

It is vital that we declare the false hood and rejection on Taghoot, keep distance from it and declare animosity, hatred and hostily towards it. There is no way for a believer to believe in and love Allah (swt) and also love the Shaytan, or any other Taghoot, rather we must hate those who hate Allah (swt) and we must hate all Taghoot as Allah (swt) tells us in the Quran through the example of Ibraheem (as) "Indeed there has been an excellent example for you in Ibrahim and those with him, when they said to their people: "Verily, we are free from you and whatever you worship besides Allah: we have rejected you, and there has started between us and you hostility and hatred forever until you believe in Allah alone." [al-Mumtahanah 60:4] So they absolved themselves from them and rejected and declared kuffr upon them and whatever they were worshipping besides Allah (swt), and they declared to them their enmity and hatred and their cutting off of love for them, until they make their worship purely for Allah (swt) alone, single Him out apart from others and remove all of the false gods from Him. It is impossible for someone to insist that any Taghoot is Muslim, we cannot disbelieve in Shaytan, distancing ourselves from him, hating him, declaring animosity on him, and then insist that he is Muslim, rather we must make Takfeer on him, and call him kafir beyond any doubt.


After all this how can one vote for man to make law which is Taghoot as mentioned, or become involved in parliaments and governments that do not rule by what Allah (swt) has revealed and vote for them and support them, when we have been ordered by Allah (swt) to reject, have animosity and hatred to them and keep distance from them.


The Taghoot are a means of misguidance and whoever makes allegiance with the Taghoot has gone far astray. Allah (swt) says “Allah is the Wali [Protector, Ally, Supporter] of those who believe, He brings them out from darkness into light. But as for those who disbelieve their awliya [allies, supporters] are Taghoot, they bring them out from light into darkness. Those are the dwellers of the fire and they will abide therein forever.” [al-Baqarah 2:257]


The one who believes in the Taghoot is cursed and he will have no help from Allah. Whoever recognises the false authority of the Taghoot or believes that they have better guidance than the Shari’ah or believes that they possess any attributes or rights belonging to Allah (swt), then they are a disbeliever as Allah (swt) says “Have you not seen those who were given a portion of the Book? They believe in Jibt and Taghoot and say to those who disbelieve ‘These people are better guided on the way’ than the believers. They are those whom Allah has cursed, and he whom Allah curses, you will not find for him a helper.” [an Nisaa’ 4:51-52]


Many peoples in the past have worshipped Taghoot and so gained the Anger of Allah and were cursed and transformed. “Say: ‘Shall I inform you of something worse than that, regarding the recompense from Allah those who incurred the curse of Allah and His wrath, those of whom He transformed into monkeys and swine, those who worshipped Taghoot.” [al Maa’idah 5:60]


Paradise is only for those who reject Taghoot and there is good news for those who avoid worshipping the Taghoot. Allah (swt) says “Those who avoid Taghoot by not worshipping them and turn to Allah, for them are glad tidings so announce the good news to My slaves, those who listen to the word and follow the best of it those are whom Allah has guided and those are men of understanding [oolul albaab].” [az Zumar 39:17-18]


Responsibility of the Believers

Today we have Taghoot dominant all over the world manifested in the rulers, governments and constitutions that are implemented and enforced throughout the world. These regimes have taken it upon themselves to become legislators by making and enforcing kuffr law and in doing so have rivalled with Allah (swt) as this is an attribute that is exclusive to Him. Instead of adhering to the command of Allah (swt) by implementing the shariah we find that these regimes implement kuffr law and give more credence to ideologies like capitalism over Islam. Hence according to the very first pillar of our belief they must be rejected and nullified by distancing ourselves from them, believing that they are our enemies, having hatred for them and declaring kuffr upon them. Again this is not a mere statement upon the tongue rather this should be manifested in our actions, as belief by definition includes the actions, for it is our actions that display what is within our hearts.


No beneficial change will occur as long as we regard as Muslims those who contradict the reason for our existence and the first pillar of Tawheed. So failing to recognise the Tawagheet as kuffaar is an error in Aqeedah and Tawheed and thus the actions that emanate from it are also in error. Much of the Ummah has accepted the enemies of Tawheed to be the leaders and their upholders of the Muslim world, and is vital that we change out beliefs and acts in relation to this.

# Know! Oh abstainer from that which has been obligated of Jihad!

Know! Oh abstainer from that which has been obligated of Jihad!
Deviator from the ways of success and correctness, that you have been exposed to expulsion and relegation. By Allah! Prevented from happiness by obtaining the objective.
What that I knew!
The reason for your abstinence from fighting and plunging yourself into the battles of the brave. Your miserliness in the path of Allah with your soul and wealth. All this is due to distant hopes, fear of an on-slaughting life span and hatred of leaving a beloved from family, wealth, son, servant, or relative.
A blood brother of yours, a compassionate relative, a generous supporter, a cherished friend, working extra pious deeds, love of a beautiful wife, a preventative high rank, a lofty position, a raised palace, a long shade, magnificent garments or wholesome food.
There is not beside these that hinder you from Jihad and none beside these distant you from the Lord of the worshipers.
By Allah! What is this from you? Oh brother! Did you not hear the words of the Most High?
"Oh you who believe what is the matter with you that when you are asked to march forward in the cause of Allah you cling heavily to the earth are you pleased with the life of this world rather than the hereafter but little is the enjoyment of the life of this world as compared with the hereafter. " [Quran 9:38]
Hearken! To that which I dictate to you of decisive evidences and listen that which I present to you of glaring proofs, so that you may learn, nothing hinders from Jihad, not even the two Holy Mosques (9) and there is no reason for your delay except the lower self and the devil.
"But I fear death! "
As for your appease to distant hopes, fear of an on-slaughting life span, vigilance of death which must occur and fear of the path which must be traversed, by Allah! Verily! Bravery does not shorten the life of the brave just as refrainment does not lengthen the life of those who lag behind:
"And every nation has its appointed term when there term is reached neither an hour can they delay nor an hour can they advance." [Quran 7:34] "And Allah grants respite to none when his appointed time comes and Allah is all aware of what you do." [Quran 63:11] .
Verily! In death there is swooning Oh tribulated one! Verily! The terror of the dying is great but you do not sense and verily! In the grave there is a punishment none is saved from it except the righteous. Verily! In it there is the Questioning of the two tribulating angels:
"Allah will keep firm those who believe with the word that stands firm in this world and the hereafter and Allah will cause to go astray those who are wrong doers." [Quran 14:27]
Then after this immense danger either blessed and to the everlasting pleasure or accursed and hence to the punishment of the fire.
The martyr is safe from all this, he fears not a thing from these destructors and the Prophet of Allah (S.A.W) has stated:
"The martyr feels not the pain of killing except like a pinch." (10 ).
So do not hinder Oh brother! From seizing this opportunity and you would be protected in the grave from punishment and you would be victorious in the reckoning of Allah.
Attaining an excellent return, you would be saved from the tribulation of the Questioning and that which is after it of intense fear, for the martyrs are alive with their Lord provided for, no fear upon them nor do they sadden.
Happy for what Allah has bestowed upon them from his favours and they rejoice their souls in the bodies of green birds flying freely in the highest parts of paradise. What a difference between this noble death and a painful death!
"But my relatives and wealth!"
If you say: "my relatives, wealth, children and family hamper me from Jihad", for Allah has stated words that are clear not concealed:
"and it is not your wealth nor your children that bring you nearer to us..." [Quran 34:37]
and the Most High says:
"Beautified for men is the love of things they covet; women children much of gold silver branded beautiful horse, cattle and well tilled land. This is the pleasure of the present World's life, but Allah has the excellent return" [Quran 3:14]
and the Most High says:
"Know that the life of this world is only play and amusement, pomp and mutual boasting among you and rivalry in respect of wealth and children, as the likeness of vegetation after rain , thereof the growth is pleasing to the tiller, afterwards it dries up and you see it turning yellow then it becomes straw. But in the hereafter a severe torment and forgiveness from Allah and good pleasure whereas the life of this world is only a deceiving enjoyment." [Quran 57:20]
There are many verses similar to this and the proofs are clear and gleaming. In a hadeeth; said
"If the present world were to be worth the wing of a mosquito in the reckoning of Allah he would not give a disbeliever a drink of water from it." (11)
and the Prophet (SAW) has said "The space of a whip of any one of you in paradise is better than the present world and that which is in it, a morning march in the cause of Allah or an evening march is better than the present world and that which is in it and the veil of a woman from the people of paradise is better than the present world and that which is in it." (12)
So how do you let hinder you from this vast kingdom a family?
Who after a while will be amongst the dead, tear them apart the hands of the dispersers and split them the decent of diseases.
With that which emanates from them of annoyance, enmity, bad manners and malevolence for that which you averted from their share to loss.
Their desertion of you when wealth is scarce and their transformation to love of you when situations change. Greater than this their abandonment of you on the Day of Consequences, holding you to account for the smallest of things at the moment of the Grand Questioning so much so that each one of them would wish that he be saved and you carry that which is upon him of sins and burdens.
How do you let hamper you that which is in the fair of departure and decline? Fleeing from you when friendship is lost and when relatives disperse.
Abandoning you every friend who use to frequent your company, then on the Day of Judgement you will be asked about him, where did you meet? And what did you do? Oh you who will be questioned!
On a day that children will become grey haired, fears intensified, crushing crowds plentiful, disputes heated, every suckling mother shall neglect her suckling infant and every pregnant mother shall miscarry (13) from the fear of that day.
The guilty shall be known by their marks and they shall be grabbed by their forelocks and their feet (14).
On that Day the rich shall be held to account for the spot on a date and the skin of a date pip, the significant and the wretched, the incomplete and complete and the poor shall precede the wealthy to paradise by five hundred years (15).
They shall feast, drink and enjoy in the abode of peace, whilst you Oh rich one! Shall be held from them because of your wealth and you will fear that you be ordered to be taken to Maalik (16).
Then do you sadden upon the departure of that (17) which if scarce increases your worries and concerns, if plentiful makes you rich and causes you to transgress, if you die you leave it behind you, of the things which you return. In front of you the standing and accounting for it, what can make you perceive?
Give it that the whole world in its entirety is yours, is not to an end its eventuality? Your departure from it is a must, even if you cling to its deceptive glory.
"But my precious son! "
If you remember your precious son and you sympathise for him the sympathy of a compassionate father, for Allah the Most High has said:
"Your wealth and your children are only a trial whereas Allah with him is a great reward," [Quran 64:15]
By Allah! He is more merciful to the child than his father, mother, brother and uncle and how not! when he had nurtured him before them with the breast of his mercy in the darkness of the interior organs.
The child's heart is in the hand of his gentleness and mercy in the womb of his mother and the loins of his father. So where was your compassion and sympathy for him when he was such? And after you where will be your closeness to him?
How do you let hamper you from the abode of pleasure and neighbouring the noble Lord? A child who if small, you are with him concerned, or large for you are with him grieved, healthy for you fear for him, sick and your heart due to its weakness restless.
If you manner him he angers and bolts or advise him, he sulks and bears grudge. With that which you expect from him of disobedience as of from many children.
If you give precedence to your cowardliness, if you pass by your miserliness, if you abstain from your preferences, then the trial will be greater.
You hold it to be a blessing, but the tribulation will prevail and you see it as a favour. You wish for him contentment at the sake of your worry, his happiness for your sadness, his profit at your loss and increase in his dirham and dinar at decrease in your scale You burden for his sake that which you can not and you enter because of him into every tight situation.
Cast him! Oh you! from your concern to he who created you and created him, trust his sustenance after you, upon the one who sustains you and sustains him. You have surrendered to Allah control of the affairs of the dominion and the realm and you do not surrender to him control of the affairs of your child after you die, and do you have even a slight control over such?
"...and to Allah belongs the domain and the earth and that is between them and to him is the return." [Quran 5:18]
By Allah! You do not posses the ability to benefit or harm him or yourself. Nor the ability of causing death, life or resurrection, you can not increase his life span by even slight nor his sustenance by the spot on a date.
Death could ravage you suddenly then you would be reduced to powder in your grave, cast down and because of your deeds held prisoner, your dear child after you an orphan.
Your wealth divided, you are inherited by an enemy or one of mercy, your family disperses in departure and residence and you say: "Oh that I would have been amongst the martyrs! I would have won an immense reward.", and it is said to you: Impossible! Impossible! Passed that which has passed. Regrets will be intensified and you will be alone with that which you have sent forth of good deeds and bad.
Verily! Listen to the words of Allah the Mighty, the Forgiving warning you about that which you are in of deception:
"Oh mankind be afraid of your lord and fear a day when no father can avail ought for his son nor a son avail ought for his father, verily the promise of Allah is true, let not then this present life deceive you, nor let the chief deceiver deceive you about Allah." [Quran 31:33]
If your child is from amongst the blessed, then you shall be joined with him in paradise and if he is of the accursed , then he shall be so from now.
The people of paradise do not join with the people of the fire, nor the pious with the wicked, it maybe that Allah grants you martyrdom and you intercede for him. Your absence from him would be an endeavour to save him, so seek that which will save you from the punishment and exert yourself in it for tomorrow:
""That day shall a man flee from his brother, and from his mother and his father, and from his wife and his children. Every man that day will have enough to make him careless of others." [Quran 80:34-37]
Verily! This is an immense declaration:
"...and Allah guides whom he wills to a straight path." [Quran 2:213]
"But my dear ones!"
If you say: "It is difficult for me to part from a brother, relative, friend or dear one", for you it is as if the Resurrection has already been established upon the entire of creation:
"Friends on that day will be foes one to another except the pious." [Quran 43:67]
For if the friendship was for Allah's sake, then you shall be joined in the highest ranks, in luxury forever and if the friendship was for other than Allah, then from now: Departure! Departure! Before comrade be joined with comrade, because a person in the hereafter is with his dear one, for his participating with the other in achieving his desire. If he is of the God fearing, his brother will benefit him and if he is of the accursed he will damage him.
With that which you expect from relatives and friends in this abode of harshness, aversion, little loyalty, much annoyance, lack of fairness, their transformation in your presence and their blame of you. Their injustice to you, their abandonment of you during loss of possessions and that which their hearts conceal of defects and diseases.
If you fall into hardship they leave you to yourself, or if you make a mistake they free themselves from you, brothers of prosperity and enemies of hardship. Their friendship necessitates affluence, their companionship is fraught with pains, if your wealth is little you are cuffed and if your situation changes he is your brother! Your brother! If you are in doubt about part of this declaration, then it shall become apparent to you with certainty during the Grand test.
If you triumph your hand from them with a brother from the best of brothers and remote is that, or a friend from loyal friends, then what will make you perceive that the two of you tomorrow as says the One truest in speech:
"And we shall remove from their breasts any sense of injury, brothers facing each other on thrones." [Quran 15:47]
So do not hamper yourself from Jihad, Oh you! With a beloved one or relative, it may be that you are split apart before death and so an immense reward passes you by. Your cherished friend separated from you and you are deprived of that which you wish of rank in paradise, you regret but your regret will avail you naught for that which has passed. In a hadeeth: Jibreel may peace be upon him said to the Prophet (S.A.W):
"Oh Muhammad! Verily Allah says to you; live as you will for verily you will die, love who you will for verily you will depart from him and do what you will for verily you will be rewarded for it." (18)
See what immense meaning these words have gathered, from the remembrance of death, departure of beloved and reward for deeds, is there a warning after this warning ?!
"...Verily in this is a lesson for those who understand." [Quran 3:13]
"But my status and lineage! "
If you say: "My lineage and high position hamper me and my honour is a preventative barrier" for what that I knew! How many have died and left your lineage? Beloved to them before it reached you and how many faded his authority from his envious obsession with it before it shadowed you.
It shall be made clear to you as it was made clear to them, in that it is as if you are already a has-been, for if you bereave at it's loss and your heart is immersed in envy, full of sadness, it will not perpetuate that which you posses of lineage and high status. You will not succeed with that which you are in search of, for it is not of the ways of salvation.
Verily! For the last to leave the fire and enter with those who have entered, there is a kingship far greater than that of the kings of this world, and ten fold (19).
For then what is your opinion of he who will be with the first forerunners, the Prophets, the truthful, the martyrs and the righteous.
It is not hidden from you that which high status entails of fatigue and tire, bad end and evil return, that which you earn due to it of many enemies and enviers and that which their inner selves gather upon of rancour and malevolence.
Their abuse of you when it fades from you, your regret and sadness upon that which has passed due to your concern and attention to it, the departure of most of your servants and the turning away from you of he who it used to gladden the kissing of your feet. At-Tirmithi and Ibn Hibaan report a hadeeth:
"The lowest of the people of paradise, for him there is eighty thousand servants, seventy two wives, a dome is constructed for him of pearls, aquamarine and gems the size of which is the distance between Al-Jaabiyah (20) and San'aa" (21, 22).
Listen to the words of the Great, the Forgiver:
"...and the angels shall enter upon them from every gate, peace be upon you for that you persevered in patience, excellent indeed is the final home." [Quran 13:23-24]
By Allah! This is what eyes are to be soothed with and so:
"For the like of this let the workers work..." [Quran 37:61]
"But my beautiful abode!"
If you say: "It is difficult for me to leave my palace, it's shade, it's raised construction, high place, my servants, couches and luxuries". What that I knew! Is it not merely a house made from stone, mud, clay, metal, wood, palm branches and cane? If it is not swept it accumulates considerable rubbish, if it is not decorated then how dark is it's darkness, if it's construction is not renovated then how quick is it's ruin, even if you renovate it, it's final result is dilapidation. After a short while it will turn to dust, those resident will depart from it, the cotton merchants will move from it, it's trace effaced, knowledge of it's existence wiped out, it's vestige erased and it's name forgotten. It has been narrated: when Allah the Mighty and Majestic descended Adam (A.S) to the earth he said:
"Build for destruction and multiply for annihilation." (23)
Exchange Oh deceived one! Your palace and it's quick rate of deterioration, for an eternal abode, whose palaces are high, it's light radiant, it's rivers flowing, it's fruit laden branches stoop low and it's delights successive.
If you ask about it's construction, for it is of silver bricks and gold bricks, no fatigue therein by far and no tire, if you ask about it's soil, for it is of sweet smelling musk (24), if you ask about it's gravel, for it is of pearls and jewels. If you ask about its rivers, for there are rivers of milk, rivers of honey and Al Kawthar (25).
If you ask about it's palaces, for there is a palace of hollowed pearl, it's height seventy miles into the air, or from green aquamarine, glistening splendidly, or from red ruby, raised it's construction. For the believer in every corner of its corner's, a family and servants, they do not see each other due to its vastness.
If you ask about it's couches, for they are lined with silk brocade, for what then is your opinion of their exterior?! They are raised amongst those who are also upon couches for forty years and there is no sleep upon them or slumber, on the contrary, they recline upon them facing each other:
"And some of them draw near to others questioning..." [Quran 52:25]
"But my nice food!"
If you ask about its food, for its substance is created, perpetual, it's fruit not limited by seasons and their supply will not be cut off for the length of that station. On the contrary there will be ripen fruits:
"And fruit that they may choose, And the flesh of fowls that they desire..." [Quran 56:20-21]
They shall be given to drink:
"...pure sealed wine, the last thereof will be the smell of musk, and for this let those strive who want to strive..." [Quran 83:25-26]
Its dwellers shall not defecate, urinate, spit or produce mucus. Their food shall perspire from their skins with an odour of musk, colour of pearls and then the stomach shall be reduced as it was (26). If you ask about its servant's for they are eternal youths:
"...if you see them, you would think them scattered pearls. And when you look there you will see a delight and a great dominion. Their garments will be of fine green silk and gold embroidery. They will be adorned with bracelets of silver, and their lord shall give them a pure drink. Verily this is a reward for you and your endeavour has been accepted" [Quran 74:19-22]
In summary, all that I have mentioned to you, is what has come of news, except for that in paradise there is what no eye has seen, nor ear heard nor occurred to the heart of man (27). If you ask about the length of stay in this great luxury, for they shall be therein forever, immortal, alive and they shall not die.
They shall be youths, never ageing, healthy, never becoming sick, rejoicing, never saddening, content, never becoming angry and from the fear of an end or expulsion they shall be forever safe (28). In a safe station:
"Their way of request therein will be: Glory! to you Oh Allah, and: "Peace, will be their greeting therein. And the close of their request will be: All the praises and thanks be to Allah, the lord of the worlds." [Quran 10:10]
So with your intelligence compare this immense, momentous kingdom and your present abode, that of a short span, small share and see that if you depart from it with martyrdom to what you will arrive. Verily! The abode that you are in is deceiving:
"...and none can inform you like him who is the All-Knower.." [Quran 35:14]
"But I would like to improve my deeds first! "
If you say: "I like to delay in order to improve my deeds", for this is also a product of deception and distant hoping. By Allah! Delay of a destined life span has never been achieved:
"Oh Mankind! Verily the promise of Allah is true, so do not let this present life deceive you, and do not let the chief deceiver deceive you about Allah. Surely Satan is an enemy to you, so treat him as an enemy, he only invites his followers, that they may become the dwellers of the blazing fire." [Quran 35:5-6]
By Allah! This is nothing but a snare of Iblees the accursed, it is not from the intentions of the friends of Allah, or the righteous, are not the companions of the Prophet (S.A.W) and the best of those who followed them more deserving than you of this intention if you are indeed of the truthful?
If they resided to delaying the life span, they would not have developed a great fear of Allah, and they would not have fought the idolaters and disbelievers, nor attack countries and lands, do you not hearken with your ears? Oh tribulated one! To the words of the Most High:
"March forth whether you are light or heavy and make Jihad with wealth and your lives in the cause of Allah. This is better for you, if you but knew..." [Quran 9:41]
Do you not take heed? If you are indeed of the intelligent and understanding and ponder upon the words of the Most High:
"...and Allah has preferred the mujahideen above those who sit by a huge reward." [Quran 4:95] In a hadeeth:
"Verily the standing of a man in the battle line for the cause of Allah is better than seventy years of worship amongst his family." (29)
Oh deceived one! Verily the sleep of a mujaahid is better than the night prayer and the fast of one who remains behind, there shall concerning this follow extra explanation (30) and with Allah lies the assistance. Suppose that you are truthful in what you claim, do not your deeds waver between being rejected and accepted? Is there not ahead of you that which terrifies and daunts? Is not your advance to the fearful day of the Gathering? By Allah! You do not know whether your deeds will save you, if you work, or destroy you!
"...and he knows what you conceal and what you reveal." [Quran 27:25] "And whether you die or are killed, verily unto Allah you shall be gathered..." [Quran 3:158]
"But my beautiful wife! "
If you say: "it does not appease my soul, departing from my beautiful wife, my delight when she is close and my happiness from her love". Give it that your wife is the most attractive of women, and the most beautiful of the people of her time, is not her beginning a despised drop?
Her last a foul corpse? And between these two she is a virgin.
Her menses prevent you from her for half her life, her disobedience to you is more than her obedience, if she does not wear kohl she becomes bleary eyed, if she does not adorn herself her roughness becomes apparent and if she does not comb her hair it becomes dishevelled. If she does not oil herself her radiance is extinguished, if she does not wear perfume musty is her smell, if she does not wash odorous is her odour, full of faults and quick to bore. If she advances in age she disheartens, if she grows old she becomes senile, you do your best and strive for her and she denies this if she becomes angry.
As the Prophet (S.A.W) has said:
"If you were to do good to one of them for a lifetime then she were to notice something bad in you, she would say: I have never seen any good from you." (31).
You desire from her the foulest part of her, you fear her desertion, you fear her harshness, your love for her carries you to exhaustion and fatigue, intense misery and distress.
She exposes you to the sources of destruction and you are pleased to fulfil the slightest of her whims at your destruction or that close to it.
She loves you because of her needs from you, if they pass by she deserts you, she abandons you and seeks for other than you.
She becomes bored with you and she makes her enmity apparent, as she says with the tongue of her condition even if she does not express it in words: "Maintain me and spend, or separate from me and divorce me!". In summary it is impossible to enjoy her except with a twist, your relationship with her will not last except with pressure and hardship.
By Allah! What a wonder!
How do you let love of her hamper you from reunion with one created from light?
Raised in the shade of palaces with youths and maidens, in the abode of luxuries and happiness, by Allah! The blood of a martyr does not dry but that he has met her.
His eyes delight in witnessing her glow, wide eyed, beautiful, exquisite, virgin, as if she were a ruby, no man or jinn has had sexual intercourse with her before you, her speech soft, her figure correct, her hair uniform in colour, her virility immense, her eyelids flitter.
Her beauty is dazzling and radiant, her coquetishness evident, her glance darkened with kohl, beautiful her elegance, sweet her speech, marvellous her creation, splendid her manners, glowingly adorned, most gorgeous of things lawful, full of love, free of boredom, her glance created only for looking at you, so she does not look at any except you.
She loves for you everything that your desires desire, if a nail of hers was to become apparent the light of the full moon would be completely extinguished and if her bracelet was to become apparent during the night, there would remain no darkness in the creation.
Were that her wrist would to become apparent the whole of mankind would become enthralled and were that she would look between the earth and the sky, it would fill between the two a fragrance. Were that she would spit into the sea, it would turn to freshwater, every time you glance towards her she is enhanced in your eye in splendour and every time you sit with her, her beauty is increased with beauty. Is it befitting of a person of intelligence that he hears of her and then sits back from reunion with her??? How? And for him in paradise are wide-eyed maidens like her and more like her! Know that separation from your wife eventually is a must, it is as if it has already happened and in paradise you shall be joined together if Allah wills. What best of joining places!
And what is between you and her reaching there if she is of the righteous, except a time during which you must separate from her and that is death. You will find her in the hereafter more beautiful than the wide-eyed maidens by a factor that none knows except the Lord of the worlds. That which you despised in her gone, that which was evil in her vanished, her manners perfected, her creation beautified, more attractive, broad eyed, a beautiful radiant woman, virgin, cleaned from menses and bleeding, removed from her all types of impurities and her crookedness straightened. Her jubilation increased, her glow expanded, her virility enlarged and she is superior to the wide-eyed maidens like their superiority over her in this present abode.
So turn away from her today for Allah's cause, he will exchange her for you and if she is of the people of paradise then you must have her.
The stark reality of this world So do not become distracted Oh you! From the eternal abode, by deception with something from the chattels of this present world, for by Allah! It is not an abode of residence, neither a place of meeting nor perfection. An abode that if it makes you laugh today it makes you weep tomorrow, if it makes you happy then succeeds it's happiness ruin, if you gather therein all the luxuries, then Allah's wrath is quick to descend upon you.
If it enriches you, it impoverishes you, if it unites it separates, if it rejoins it disperses, if it diminishes it congests, if it enriches it overburdens, if it increases it eradicates, if it constructs, it destroys, if it produces it flees, if it elevates it topples and if it becomes peaceful it oppresses.
If it's graces prevail, it causes grief with it's evil results, if it revitalises with it's reunion then weaning follows it, it's closeness is far, it's beloved one dejected, it's drink a mirage and it's sweetness punishment.
The abode of worries, sadness, distress, anxiety, transition, separation, wretchedness, schism, disease, fatigue, hardship and tire. It's plenty is little, it's noble one abased, it's rich one poor, it's venerable one menial, plenty of defects, full of regrets, scarce of serenity, devoid of fulfilment, no trust in it's pacts and never fulfilling its promises.
The one who loves it is wretched, the one who desires it is mad and the one who trusts in it is shamed. It has covered its defects, hidden its disasters, it is treacherous with its falsehood, deceiving with its bribes, it has set its meshes and placed its nets. It has made permissible its falsehoods and unsheathed its sword. It has made permanent its traits, concealed its ugliness and it calls; "Embrace me! Embrace me! Oh men!". For he who seeks reunion with it falls into its plot, it manifests upon him its evil condition, it intensifies its punishment and he falls into it's captivity because of his ignorance of its evil. He is afflicted by its plotting, so much so that he does not perceive its affair, until he bites his hands in regret, he cries blood after tears, it forsakes him to what he desired until he meets an evil return. He struggles to flee but escape is impossible.
So awaken yourself! Oh you! Before destruction, free yourself from its captivity before it becomes difficult to escape. Prepare to proceed to success and happiness, maybe Allah will grant you martyrdom from his grace, so do not let hamper you from this reward, a reason from these reasons. For the one of sound assurance is he who exhibits strong resolution and the one of rational opinion is he who has a share in Jihad. He who clings to laziness and is deceived by hopes, his feet shall slip, he will regret where it will not avail him ought regret, he will gnash his teeth about that which has slipped and passed when he witnesses the martyrs in the highest most chambers of paradise:
"...and Allah says the truth and he guides the way." [Quran 33:4] "...Allah is sufficient for us and the best disposer of our affairs." [Quran 3:173]

apparent ruling built upon strong speculation, and Allah knows best."(Fathul-Baari:6/90) Sheikhul-Islam, Ibn-Taymia has quoted from the consensus of the scholars: The residing of a man in the land of ribaat as a muraabit (one who makes ribaat) is better than his residing in Makkah, Medinah or Baitul-Maqdis. This is an abridged extract taken from the book "Mashaa're Al-Ashwaaq Ila Masaa're Al-Ushaaq wa Muththeer Al-Gharaam Ila Daar As-Salaam" on the topic of Jihad by: Abu Zakariah Ahmad bin Ibraheem bin Muhammad Ad-Damishqy and then Ad-Demyaaty (1), well known as Ibn-Nuhaas, who was martyred 814 hijry. The scholars of Islam mention him as following: Al-Haafiz Ibn Hajr Al-Asqalaany (2) states: "He was inseparable from Jihad in the front line of Demyaat, and this is a perfect and excellent quality". As-Sakhaawy (3) states: "He strove in doing good, and preferred obscurity, he did not become proud because of his knowledge, on the contrary maybe those who did not know him would think him to be a commoner, with his pleasant appearance, beautiful beard, stocky and even body, he participated much in ribaat (4) and Jihad until he was martyred" Abu Imaad states: "The Sheikh, the Imam, the Scholar and the Example" During the year of 814 A.H. (1411 CE) the enemy attacked the people of At-Teenah, a village in Egypt, and the people of Demyaat marched to their help, the most notable of them being Ibn-Nuhaas. There then flared an immense battle between the two sides and Ibn-Nuhaas was killed whilst attacking the enemy not fleeing. Modern day scholars mention his works as following: Abu Abdul-Faatih Alee bin Haaj (5) states about this very extract: "The best that I have read from Ibn-Nuhaas Ad-Demyaaty is an investigation which explains the reasons for sitting back from Jihad in the cause of Allah the most high, so I wish to quote it in it's entirety for that which it contains of benefits for the rest of the brothers, maybe Allah will awaken the sleeping concerns..." The Verdict Regarding the One Who Defensively Argues on Behalf of the Tāghūt
By the imprisoned Shaykh, the Mujāhid Shaykh ‘Alī ibn Khudhayr Al-Khudhayr
May Allāh hasten his release from the prisons of the Tāwaghit) from at-Tibyān Publications

Question


“There is a certain individual who defends (in arguments) the Tawāghīt day and night, and the Hujjah (evidence) has been established upon him dozens of times – yet he makes excuses for the actions of the Tawāghīt. So what is the ruling regarding such an individual ?”


Shaykh ‘Alī Al-Khudhayr (may Allāh hasten his release) answered:

If these Tawāghīt are kuffār (in his eyes, meaning) that their kufr has been established – and he views them as kuffār – and then yet he defends them: Then he is a kāfir just like them. As Allāh (Most High) has said:

“And those who disbelieve are allies to one another…” [Al-Anfāl: 73]
And because his action of defending them, is Tawallī (alliance) with them. And Allāh has said:

“And thus We do make the Thālimīn (polytheists and wrong­doers) Awliyā’ (supporters and helpers) one to another, because of that which they used to earn.” [Al-An’ām: 129]


And He (Most High) has also said:

“Verily, the Thālimīn (polytheists and wrong­doers) Awliyā’ (supporters and helpers) one to another, but Allāh is the Walī (Helper, Protector) of the Muttaqīn.” [Al-Jāthiyah: 19]


But on the other hand: If he thinks that the rulers are upon Islām, or reality of their situation is in doubt – Then as long as you continue to give him your sincere advice and admonishment, then you have fulfilled your obligations.


But, if he thinks they are not upon kufr, but he is aware of their oppression and betrayal, and yet argues in their defense – then for him is the Statement of Allāh (Most High):

“And argue not on behalf of those who deceive themselves.” [An-Nisā’: 107]

And:

“So be not a pleader for the treacherous.” [An-Nisā’: 105]


And:

“My Lord! For that with which You have favored me, I will never more be a helper for the Mujrimūn (criminals,polytheists, sinners, etc.)!” [Al-Qasas: 17]

# A Message from JUS

Eid Mubarak!


On the occasion of Eid Al-Adha, 1427, we would like to take a moment to send our sincere greetings to you and your family on this blessed occasion and to share the good news of the Islamic awakening that is upon us.


As the end of the year approaches, we would also like to take this opportunity to congratulate the Muslims on the progress we have made during this past year. Many more of you now see that the Ummah is a nation at war against an aggressive American foreign policy that will not stop until our lands are decimated, our resources are pilfered and our religion has been subdued. Many more of you now see that the events of 911 were not the beginning of this war but were a response to a decade of abuse beginning with the occupation of the land of the two holy mosques, the brutal embargo that killed over 1 million of our children in Iraq, and the indiscriminate bombings of Sudan, Afghanistan and Iraq and the continuing ethnic cleansing of Palestinians that has gone on for half a decade.


It is no longer hidden from any of us, Muslim and non-Muslim alike, that America’s agenda has nothing to do with “terrorists” and has everything to do with controlling Muslim land, resources and minds. Five years on in this so-called war on terror the Mujahideen have proven once again that Allah is capable of all things.


In Afghanistan, Commander of the Faithful Mullah Omar has waged an unprecendeted defense after US forces claimed to be “moping up” in 2002. The Islamic Emirate of Afghanistan has been formed, Shariah law has been implemented in the that lands it controls and Afghans are flocking to support the Mujahideen.


Moreover, in Iraq, three years on in the illegal occupation of the country, our second Islamic Emirate has been formed, the new Islamic State of Iraq, and our Mujahideen have put up an impressive and relentless resistance against the worlds largest superpower proving that all the military hardware in the world can not defeat the hand made weapons of the Mujahideen if Allah wills it. The Islamic awakening is indeed occurring among the youth and the sincere ones and Allah has honored their efforts. The US is now entrenched in a war it can not win and both Muslims and non-Muslims are awakening to the real agenda behind this current assault on Islam.


While the media battle remains front and center in this conflict, like all the others, it is also a difficult battle. With mainstream news reporting having digressed to merely party-line propaganda, now more than the Muslim voices must speak. At JUS, over the past year, we have brought back the popular Jihad Unspun as a free daily news source in order to counter the sea of misinformation. We have repositioned JUSone to a news magazine with indpeth articles that relect the thoughts and views of Muslims and we are working on a variety of initiatives to better our reach and effectiveness.

India: Israel's single largest arms customer


Jerusalem: Buoyed by Indian defence procurement worth US$1.5billion, the Israeli defence industries have recorded all time high sales figures in 2006. "India was Israel's biggest customer with purchases reaching USD 1.5 billion," Maj Gen. Yossi Ben-Hanan, head of SIBAT, the Foreign Defense Assistance and Defense Export Department at the defence ministry told 'The Jerusalem Post'.


It included Israel's single largest sale to a foreign country made by the Israel Aircraft Industries in the sale of the Barak Naval anti-missile defense system, valued at some US$450 million, Ben-Hanan told the daily.


Unperturbed by the US entry into the Indian market, the defence official said it would not make a dent in Israeli defence sales to New Delhi. "America sells fighter jets, tanks and helicopters and we do not compete with them," Ben-Hanan said. On the contrary, he said, that it may even lead to an increase. "We can for example sell the necessary accompanying systems that they will need alongside the larger US platforms," Ben-Hanan noted.


Defence Industries sources said that "despite certain speculations the bilateral defence ties remain as strong as ever". Chief of Air Staff Air Chief Marshal S.P. Tyagi and Navy vice-chief Vice-Admiral Venkat Bharathan, among others, visited Israel in 2006 to re-affirm the strong ties. Joint R&D projects for more advanced radars, long endurance and high altitude UAVs, electronic warfare systems, third generation night fighting capabilities and such other areas are being explored for cooperation.


As per the sources, missiles and anti-missile defence systems however remain a priority area. Breaking an all time record, the Israeli defense ministry announced on December 31 that its sales reached just over 4.4 billion USDs in 2006, placing it among the top five exporters, just behind the United States and England.


Over three-quarters of the total sales were to foreign countries and the remaining was purchased by the Israel Defence Forces. "This is a great achievement. The world has put its faith in our industries through the deals it has signed with Israeli companies," Ben-Hanan said.
